Definitions by Law

By Owner, We, Us and Our mean the supplier of the equipment, PJS+POSIES. You or Your, means the Client hiring the equipment.  All party items provided is all equipment hired by Us to the Client. The Client, by placing an order via online, email or phone, agrees that they accept the conditions of the rental agreement.

TERMS & CONDITIONS

The agreement for the hire of equipment is between PJS+POSIES and the Client. PJS+POSIES will retain a booking form and signed terms and conditions agreement, which the Client will then be supplied an invoice as confirmation of their booking. Hire periods will be no longer than 24 hours unless agreed at the time of booking.

DEPOSIT

A non-refundable deposit of $100 is due at the time of booking in order to reserve your party date and theme, payable through PayPal (Visa, Mastercard, American Express, Discover). The remaining balance is due no later than 48 hours before the party date, in addition to a completely refundable $250 damage deposit.  Final payments not received by this time will result in the cancellation of your party without exception. Minimum party booking cost is $500.

CANCELLATIONS

Cancellations within 14 days of the event date will not receive a refund. The $100 deposit is non-refundable, but may be applied towards the cost of another party if held within 90 days of the original party date. If you choose to cancel our services for any reason, your deposit will be forfeited. The costs of add-on items are non-refundable.

FINAL PAYMENT

All outstanding balances are due 48 hours prior to delivery. The remaining balance is based on the package and any additional add ons.

FORMS OF PAYMENT

PJS+POSIES accepts all major credit cards including Mastercard, Visa, Discover and American Express. Payment is processed by PayPal.

CARE

The tents and equipment items are for indoor use ONLY.Party tables, chairs, shimmer wall backdrop, and selfie ring light and tripod stand may be used for indoor or outdoor.

STRICTLY NO PETS allowed on the party tent equipment. We kindly ask that no craft supplies, makeup, slime of any sort, nail polish, messy food, or drinks be inside or around the tents at any time. Popcorn is Okay. All parties must be held in smoke-free environments. PJS+POSIES reserves the right to forfeit your booking without refund if staff finds your property to be unsafe for our staff or contain cigarette smoke odor.

All hired equipment remain the property of PJS+POSIES.  The Client is responsible for the hired equipment during the period of hire. It is the responsibility of the Client to take duty of care and always supervise children with the hire equipment. Diligence must be taken with younger children on the Client’s premises as PJS+POSIES hire equipment is not recommended for children under the age of 5.

DAMAGES

The Client is responsible for the care of PJS+POSIES equipment during the party event. If equipment is damaged, lost, or stolen the Client agrees to reimburse PJS+POSIES for damage or replacement (other than ordinary wear and tear resulting from anticipated, reasonable and proper use).

DAMAGE CHARGES

The Client agrees to pay the following amounts per damaged item, should an item be damaged while on their premises indicative replacement costs include: PJS+POSIES Teepee $300, Mattress $150, Blankets $30, Decorative Pillow $50, Fur Rug $75, Bed Tray $50, Night Light $20, Fairy Lights $10, Additional decor items $10.

Equipment returned in an excessively dirty condition, resulting in the Equipment requiring a complete deep clean will incur a minimum charge of $300.  This could include, but is not limited to, spillage of fluids, slime, food, pen marks, nail polish, vomit, other stains and unpleasant odors including cigarette smoke. Charges will be made for any damaged equipment  including equipment that has been scratched, burned, holes, rips and tears, candle wax, grease marks, deep staining that cannot be removed, or any other damage that in our opinion diminishes the value of the equipment.  

If the cost of damages exceeds the amount of the damage deposit, an invoice outlining amount of damage and costs will be sent to the Client and must be paid by the Client within 24 hours.

The damage deposit will be held to cover any potential damage or additional cleaning. It will be returned in part/full dependent on a check of all equipment.

DELIVERY

PJS+POSIES requires that the designated tent areas be cleared of furniture. PJS+POSIES representatives are prohibited from moving furniture. We require that floors of designated equipment area be clean before our arrival.

Lauren and/or Rachael or a representative(s) of PJS+POSIES will deliver the items to the Client at a mutually agreed time the day of the party, set up the party, and will collect the items  the day after.  Delivery and collection are included in the price of the booking.

PJS+POSIES reserves the right to decline our service to certain locations in any city or neighborhood that may compromise our staff’s safety. We serve Santa Barbara County in Santa Ynez Valley and surrounding areas. Travel costs will incur outside of area.

COLLECTION

Lauren and/or Rachael or a representative(s) of PJS+POSIES will arrive the day after the party, at a previously agreed up time, to collect items and equipment. A quick inspection of all items will be completed at the time of pick-up to confirm there are no obvious damages or issues. A thorough inspection will be completed “during the week” after your party to inspect for any damages that may have been missed in the initial inspection. At this time the damage deposit will either be returned or used to replace any damaged items.

If equipment is not returned at the end of the agreed hire period, PJS+POSIES retains the right to charge for: 

-The cost of replacement equipment.

LIABILITY TO THIRD PARTIES

We strictly provide entertainment equipment. Please be aware that children need to be supervised at all times. No jumping on mattresses and or climbing on equipment. PJS+POSIES will not be liable for any claim for personal injury, death, loss or damage to the property/equipment however caused. The Client is responsible for reporting any allergies of party guests and the Client must insure that a party guest with the allergen(s) does not consume or come into contact with the allergens which cause an allergic reaction.

WE HAVE BEEN GIVEN ASSURANCES OF PRODUCT SALABILITY, MERCHANTIBILITY, AND COMPLIANCE FROM THE MANUFACTURERS. IN NO EVENT SHALL WE BE LIABLE TO YOU OR ANY THIRD PARTY FOR CONSEQUENTIAL, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE OR ENHANCED DAMAGES, LOST PROFITS OR REVENUES OR DIMINUTION IN VALUE, ARISING OUT OF, OR RELATING TO, AND/OR IN CONNECTION WITH ANY BREACH OF THESE TERMS, REGARDLESS OF (A) WHETHER SUCH DAMAGES WERE FORESEEABLE, (B) WHETHER OR NOT WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND (C) THE LEGAL OR EQUITABLE THEORY (CONTRACT, TORT OR OTHERWISE) UPON WHICH THE CLAIM IS BASED.

OUR SOLE AND ENTIRE MAXIMUM LIABILITY, FOR ANY REASON, AND YOUR SOLE AND EXCLUSIVE REMEDY FOR ANY CAUSE WHATSOEVER, SHALL BE LIMITED TO THE ACTUAL AMOUNT PAID BY YOU FOR THE HIRE OF EQUIPMENT FROM PJS+POSIES.

SAFETY

The Client is responsible for safety use of equipment and each child agrees to follow the code of patron responsibility:

a) Patrons have a duty to exercise good judgment and act in a responsible manner while using the equipment. Patrons have a duty to obey all oral or written warnings, or both, prior to or during participation, or both.

b) You have a duty to supervise the children during the Slumber Party and remove inappropriate objects including sharp or dangerous objects.

c) You agree to explain all rules to each Child attending the party, and to ensure that each Child obeys the rules.

OWNERSHIP

All Equipment remains at all times the property of the PJS+POSIES.

PRIVACY

PJS+POSIES will never pass on, sell or distribute Client information to any third party.

All material on PJS+POSIES website and on social media pages including photographs, layout, design, and graphics are owned by PJS+POSIES and are copyright. Unauthorized use is prohibited.
